Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LinkDevi platform, website, and services (collectively, the "Service") operated by LinkDevi ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Account Terms

• You must be at least 13 years old (or 16 in the EEA) to use the Service.
• You must provide a valid email address and accurate information to create an account.
• You are responsible for maintaining the security of your account and password. LinkDevi is not liable for any loss or damage arising from your failure to protect your credentials.
• You may not use the Service for any purpose that is illegal or prohibited by these Terms.
• One person or legal entity may maintain no more than one free account. You may create multiple paid workspaces.
• You are responsible for all activity that occurs under your account.

2. Acceptable Use

You agree not to use LinkDevi to:

• Create short links that redirect to malware, phishing pages, or any content designed to harm users or their devices.
• Distribute spam, unsolicited messages, or deceptive content through short links.
• Shorten links to content that is illegal in the jurisdiction where it is accessed, including but not limited to child exploitation material, illegal drug sales, or terrorism-related content.
• Infringe upon or violate the intellectual property rights of others.
• Use the Service to harass, threaten, or impersonate other individuals or organizations.
• Attempt to gain unauthorized access to the Service, other user accounts, or our systems.
• Use automated tools to create links in excess of your plan limits or to circumvent rate limiting.
• Use link cloaking features to disguise the true nature of harmful or deceptive content.

We reserve the right to disable any short link, suspend, or terminate accounts that violate these terms, without prior notice.

3. Payment Terms

• Paid plans are billed in advance on a monthly or annual basis, depending on the billing cycle you select.
• All fees are exclusive of taxes unless stated otherwise. You are responsible for applicable taxes.
• Payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for the applicable fees.
• Prices may change with 30 days' prior notice. Price changes will take effect at the start of your next billing cycle.
• Refunds are available within the first 14 days of a new subscription or upgrade. After 14 days, no refunds are provided for the current billing period.
• If payment fails, we will attempt to charge your payment method again. If payment is not received within 7 days, your account may be downgraded to the Free plan.

4. Cancellation and Termination

• You may cancel your subscription at any time from your account settings. Your plan will remain active until the end of the current billing period.
• Upon cancellation, your account will be downgraded to the Free plan. Links created under paid features (custom domains, A/B testing, etc.) will continue to redirect but cannot be edited until you resubscribe.
• We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.
• You may request full account deletion by contacting us. We will process deletion requests within 30 days.
• Upon account deletion, all your links, analytics data, bio pages, and associated content will be permanently removed.

5. Service Availability

We strive to maintain 99.9% uptime for link redirects and the dashboard. However, we do not guarantee uninterrupted access to the Service. Scheduled maintenance will be communicated in advance. We are not liable for any downtime caused by circumstances beyond our reasonable control, including but not limited to natural disasters, third-party service failures, or cyberattacks.

6. Intellectual Property

The Service, including its design, code, branding, and documentation, is the intellectual property of LinkDevi and is protected by applicable copyright and trademark laws.

You retain ownership of the content you create through the Service (destination URLs, bio page content, custom settings). By using the Service, you grant us a limited license to process and display your content as necessary to provide the Service.

7. API Usage

Access to the LinkDevi API is subject to the rate limits and usage restrictions of your plan tier. Exceeding these limits may result in temporary throttling or suspension of API access. You must not share your API keys with unauthorized parties or use them in ways that could compromise the security of the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINKDEVI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Indemnification

You agree to indemnify and hold harmless LinkDevi and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which LinkDevi operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
